In 1986, Timothy Cole was convicted of the rape of a Texas Tech student. It was a rape that he did not commit. Cole maintained his innocence the entire time that he was in prison. In 1999, 13 years into his 25 year sentence, Cole died of asthma complications.
The actual rapist came forward in 1995 to confess to the crime. However, he went unheard and Cole remained in prison. Now, with DNA evidence and the confession, Cole will be exonerated, making him the first person in Texas history to be exhonerated posthumously for DNA evidence.
