In 1978, David Lee Powell was convicted of killing police officer Ralph Ablanedo with an AK-47 assault rifle. Powell has been sent to death row three times for the crime, but has appealed each time.
Powell’s most recent appeal contended that his last trial should have been a full one rather than simply a punishment trial. However, the Supreme Court has refused to review Powell’s most recent appeal.
