Family of Wrongfully Convicted Man Seeks Posthumous Exoneration

In 1986, Timothy Cole, then a student at Texas Tech University, was convicted of raping fellow student Michelle Mallin. After rejecting a plea deal, Cole was sentenced to 25 years in prison. In 1999, he died of an asthma attack in jail.

Recent DNA testing, however, showed that Cole was wrongly convicted of rape; another man, who was already serving consecutive sentences for sexual assault, admitted to the crime. Now, Cole’s family, Michelle Mallin, and the Texas Innocence Project are joining forces to seek a posthumous exoneration for Timothy Cole. If they succeed, the exoneration will be the first of its kind in the state of Texas.
